SNOWCAP COAL COMPANY <br />South Portal <br />Roadside Refuse Disposal Area Inspection - 3rd Quarter 2006 <br />On September 26, 2006, I performed the required quarterly visual inspection of the <br />Roadside Refuse Disposal Area in accordance with Rule 4.10.2. <br />I, J. E. Stover, P.E., have a wide variety of experience in the design and construction of <br />earth fill embankments. Nothing was observed during the inspection that would indicate <br />the pile has a potential for failure. The entire pile was dry including the terraces. There <br />was no seepage noted around the pile. The upper diversion ditch was inspected with no <br />problems noted other than minor sediment build up in a few areas. During the quarter a <br />significant precipitation event caused the steep section of the upper diversion ditch to <br />fail. The ditch was subsequently repaired. On September 6, 2006, the undersigned <br />certified the RSRDA upper diversion segment "B" was restored to meet the applicable <br />performance standards and the design criteria presented in Snowcap's Mining and <br />Reclamation Permit, C-81-041. <br />A failure of the pile would probably not be a hazard to human life. Even though the pile <br />is fairly close to the Interstate 70 east bound lanes, if the coal mine waste bank failed, it <br />is unlikely the material would move far enough to encroach upon the freeway. <br />I certify that to the best of my knowledge and belief, that the fill and other aspects of the <br />Roadside refuse pile have been constructed as permitted in the design approved by the <br />DMG. <br />Recommended maintenance: Minor sediment removal on the upper section of the <br />upper diversion ditch. <br />•-o o <br />P.E. ~ °19230 0 6 <br />c+ o <br />e0eQ lY ~~'~`~p0 <br />Date <br />
