water from the easement to the servient estate. Said easement shall <br /> permit the Grantee to operate up to three sump pump stations within <br /> the easement, and shall permit power lines, pipes for the trans- <br /> portation of water and any other necessary access for the <br /> installation and maintenance of said sump pump stations; provided <br /> Grantee shall not unreasonably or unnecessarily interfere with <br /> Grantor's use and enjoyment of the dominant estate, and provided said <br /> power lines, water pipes and sump pump stations shall, to the extent <br /> it is reasonably feasible, be kept concealed or camouflaged. Enjoy- <br /> ment of this easement shall, in addition, require that the Grantee <br /> not discharge or permit the discharge of any water taken under this <br /> easement directly upon the dominant estate without Grantor's <br /> permission. Water removed under this easement shall be limited to <br /> use on the servient estate by the Grantee for any rightful purpose. <br /> Neither this contract nor this easement conveys any right, title or <br /> interest in water. This easement shall be deemed abandoned if Grantee <br /> shall fail to actively operate and maintain sump pump stations for use <br /> in the extraction or preparation of gravel for three successive years. <br /> (d) Grantor shall grant to Grantee an easement from the <br /> servient estate across the dominant estate to the Eagle River for the <br /> installation and maintenance of a pipe for the transportation of <br /> water; provided that Grantee's use of this easement shall not <br /> unreasonably or unnecessarily interfere with the Grantor's use and <br /> enjoyment of and access to the dominant estate. This easement shall <br /> be located in the place marked on the Exhibit A map, and shall be <br /> more properly described by a survey. This easement shall be for <br /> the limited purpose of discharging water from the servient estate <br /> into the Eagle River, where said water has been used in the mining and <br /> preparation of gravel. This easement shall be deemed abandoned at <br /> the time Grantee shall have abandoned the active mining and preparation <br /> of gravel mined on the servient estate for three successive years. <br /> 9.
