r <br /> 7. General Taxes. General taxes for 1978 shall be apportioned to <br /> date of Purchaser' s possession, and shall be based on the most recent levy and <br /> the most recent assessment. <br /> 8. Easements. In this paragraph the term "servient estate" shall <br /> mean the Property; the term "dominant estate" shall mean that land described in <br /> Exhibit B attached hereto and by this reference incorporated herein; the term <br /> "Grantor" shall mean the Seller; the term "Grantee" shall mean Purchaser. <br /> (a) Grantor shall reserve an easement in perpetuity to <br /> move livestock across the servient estate, to and from the dominant <br /> estate; provided that Grantor shall not unnecessarily interfere with <br /> Grantee's use and enjoyment of the Property, and provided that <br /> Grantor shall hold Grantee harmless from any damage to Grantee's <br /> real or corporeal personal property which livestock crossing the <br /> servient estate under this easement shall cause. <br /> (b) Grantor shall reserve an easement in perpetuity for <br /> access, including vehicular access, from U. S. Highway No. 6, <br /> across that railroad crossing which crosses the Denver and Rio <br /> Grande Railroad right-of-way closest to the Alkaline Creek drainage, <br /> and across the servient estate along the road which runs from said <br /> railroad crossing across the servient estate north to the dominant <br /> estate. Said easement shall be approximately 50 feet in width and <br /> shall be more particularly described by survey prior to closing. <br /> Grantor reserves the right to reconstruct or construct a road <br /> within this easement. This easement may be jointly used by <br /> Grantor and Grantee, and if jointly used, shall be jointly <br /> maintained; but if used exclusively by one of the parties for a <br /> period of a year or years, it shall be the using party's obligation <br /> during said period to maintain this easement. <br /> (c) Grantor shall grant to Grantee an easement on the <br /> dominant estate 25 feet in width along the common boundary of the <br /> dominant and servient estates. This easement shall be for the <br /> purpose of establishing and maintaining pumping stations to pump <br /> -3- <br />
