Shelton <br />Director <br />November 12, 1980 <br />TO: Ed Bischoff <br />FROM: Jim Pendleton <br />RE: Geotechnical Rspects of Empire Energy's Revised .Application <br />(dated 2/Z8/80) for the Underground Eagle Nos. 5 and 9 Coal Mines <br />I am aware that the staff is currently reviewing the Empire <br />Energy permit application in order to ascertain its comply=teness in <br />regard to the permanent Colorado Regulatory Program. In this regard <br />the points in my memo to Roger Funston of March 12, 1980 (attached <br />hereto) are still pertinent. In addition, I offer the following <br />supplemental observations. <br />Ground Surface Subsidence <br />1. I have been informed by Jim Nerron that additional ground surface <br />subsidence occurred during the past summer. I expect the Empire Energy <br />application and its appropriate exhibits to be updated to discuss these <br />events and their implications for the proposed subsidence control program. <br />2. The application should include "a description of the worst possible <br />consequences which subsidence, if it occurred, could have...", in accord <br />with permanent Colorado Regulatory Section 2.05.6(6)(b). <br />3. The subsidence monitoring program should be amended to conform with <br />the requirements of the permanent Colorado Regulatory Section 2.05.6(6) <br />(c) . <br />Proposed Mine Waste Pile Stability. <br />As per my memo to Roger Funston dated June 13, 1980, Empire Energy has <br />stipulated submittal of mechanical materials testing to verify the <br />assumptions made in CTL Thompson's slope stability analysis of the waste <br />pile. That data is due for submittal prior to December 3.1, 1980, in order <br />to fulfill the stipulation of last summer's interim permit. The permanent <br />program permit application should include that material's data as well as <br />a statement of its implications for the original stability analysis. If <br />that data were to contradict the assumption of the original anlysis, the <br />analysis should then be amended. <br />/k <br />attachments <br />
