<br /> <br />Menzer Quarry Annual Report <br />Additional Sheets `~ ~ ~ ~ I V ~ i~ <br />Permit M-76-009-HR <br />Anniversary Date: December 31, 1996 t~ ~ 3 1990 <br />Centennial Materials <br />The following information is keyed to the enclosed annual report maps. <br />Map 1: This map shows the permit boundaries and the edge of the affected land. Since 1992, <br />Centennial has been reporting the permit acreage as 56 and has been using that boundary, <br />shown in green on the map. Review of [he files appears to show that the 56 acre boundary may <br />be in error. Because [he permit was never formally amended from [he original 40 ;rcre <br />boundary the 56 acre boundary is not a Board approved boundary. That area became the <br />boundary as a result of an agreement between Harry Pose of DMG and Gregg Shi~ur of <br />Schmidt Construction, a sister company of Centennial Materials. Although it can lie argued <br />that the 56 acre boundary is legal because that was what was agreed to, the law does not allow <br />permit areas to be increased by that means. As a result of an inspection by Berhan Keffelew in <br />October 1996, a Reason to Believe letter was issued for affecting land outside the permit <br />boundary (56 acre boundary). Because of an amendment Centennial submitted on December 2, <br />1996 and because of the confused nature of the boundary issue, the Reason to Believe letter <br />was withdrawn before Board consideration. The amendment includes all the affeco:d land that <br />is outside the 40 acre (red line) boundary shown on the map, most of which has been affected <br />since the permit was first issued in 1977. The proposed amendment boundary is not shown on <br />this map, but is on the maps submitted with the amendment. <br />Map 2: This map shows the various classes of affected land on the site, inside and outside the <br />40 acre permit area (red line). <br />Revegetation (5.8 acres) -This revegetation represents what was done over the past <br />several years to revegetate disturbed areas on the site. No revegetation was done in 1996. <br />Plant & Processing (16.1 acres) -This area expanded westward in the last year as the <br />mining resulted in a slight expansion of the quarry floor. During 1997, it is not expected that <br />this area will show significant changes in its extent. <br />Mining (12.95 acres) -This, as shown on the map, is divided into two parts. The large <br />area is the area where most of the mining has occurred over the last many years. 'T'his area is <br />nearly finished with the full extent of extraction. However, when the amendment i~ approved <br />this will be remined as part of Phase 1 in the amendment.
