Banta. <br />Division Deecior <br />Re: Herman Feit Pit, Transfer of Permit and Succession of Operator<, <br />Permit No. M-77-522 <br />Dear Mr. Richardson: <br />The Division is currently processing a request for transfer of permit and <br />reclamation responsibility for the Herman Fe it Pit, Permit No. M-77-522. We <br />have received completed applications for succession of operators, performance <br />warranty, and financial warranty. <br />One of the provisions of the performance warranty is that the operator comply <br />with all applicable requirements of the Act with regard to those affected <br />lands. This entails a commitment by the operator to comply with all <br />applicable federal, state, and local laws pertaining to disturbance and <br />reclamation of the affected land. <br />A review of the mining and reclamation plan as submitted in the original <br />permit application on October 31, 1977 indicates that the following ~~ermits <br />may be necessary: <br />1. National Discharge Elimination System (NPDES) Permit - <br />Colorado Department of Heal th , Water Quality Control Division <br />2. Air Emissions Permit - (fugitive dust generated from the crusher <br />operation) - Colorado Department of Health, Air Quality Control Division <br />3. 401 Dredge and Fill Permit - U. S. Army Corps of Engineers <br />4. Water Well Permit - State Engineer's Office, Colorado Department: of <br />Natural Resources (please refer to attached Senate Bill 120). <br />Review of the file for Permit No. N-77-552 indicates that on June 2, 1989 <br />NPDES Permit No. CO-5000022 was transferred from Goodell Brothers to River <br />Valley Rock, Inc. The Division would appreciate receipt of a document from <br />either River Valley Rock, Inc. and/or the Colorado Department of Health, <br />Water Quality Control Division regarding the status and expiration date of <br />Permit No. CO-5000022. <br />
