A statement of the professional dualifications of the certifying professional. <br />Mr. Walker was graduated from the Colorado School of Mines with a Professional Degree in Geologipl <br />Engineering in 1959, and from the Missouri School of Mines at Rolla with a Bachelor of Science Degree <br />Equivalent in Civil Engineering in 1964 and a Master of Science Degree in Civil Engineering (major in Soils <br />Engineering) in 1966. His pertinent experience includes construction of drainages structures, impoundments <br />for dredge spoils, and erosion control and wildlife water dams and ponds; teaching [earthwork (including <br />hydrology and drainage) design, methods of construction, construction management, and quality control <br />(including soil material testing)]; review and management of design and construction of dredge spoil <br />containment structures (impoundments); and inspection of sedimentation dams for safety, stability, and <br />operational effectiveness. He is a registered Professional Engineer in the States of Colorado and Missouri. <br />~, A citation of the Rule reuuiring the certification. <br />The requirement for this certification is Rule 4.05.9 (]0) and (11) of the Regulations of the Colorado Mined <br />land Reclamation Board for Coal Mining. <br />f~. A sceciric description of the subiect of the certification. <br />The subject of this certification is sedimentation Pond Number 002 in Permit Number C-81-023, and concerns <br />items (a) through (e) presented above. The structure is earthen embankments. Appurtenant structural <br />elements include a primary spillway [corrugated metal pipe (CMP) trickle tube provided with a baffle plate] <br />and an emergenry spillway (riprap-lined earth). The permit is to conduct a mining operation known as the <br />Chimney Rock Mine for the purpose of extracting coal, and was issued to Kaiser Steel Resources (now Kaiser <br />Ventures, Inc.). The Chimney Rock Mine (including the subject pond) is located in Archuleta County, State <br />of Colorado, in Township 34 North, Range 4 West, New Mexico Prime Meridian, approximately 22 miles <br />southwest of Pagosa Springs, Colorado. <br />This certification is limited to the scope of Rule 2.05.9 (]0) and (11) as regards the existing sedimentation <br />pond, and is based on the Sedimentation Pond As-Built, 7-7-91, Rev. 1, and other information found in Exhibit <br />7 of the Permit. This certification does not extend to verification that the Sedimentation Pond As-Built, 7.7- <br />91, Rev. I and other information Cound in Exhibit 7 represents existing conditions in the field, nor that the <br />structure was designed, built, or operated in compliance with Rules 4.05.2 through 4.05.9 of Colorado Mined <br />Land Reclamation Division regulations (Permit, Section 2.05.3, Ponds. Impoundments and Diversions, page <br />2.05-2). <br />!~ A statement of the actions taken in preparing the certification. <br />The [ollowing were reviewed: Rule 4.05.9 (10) and (11) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining; Mined Land Reclamation Division letter July 13, 1984; the 1995 annual <br />certification; permit documen[ation; the Dam Safety Manual (State Engineer's Office, June 3, 1983); 2 CCR <br />402-1, Rules and Regulations for Dam Safety and Dam Construction. Mr. Walker made a site visit and <br />inspection on 29 October 1996. Mr. Hockett, of Elk River Construction Company, is experienced in small <br />earthen dam (pond) construction, and made the first three 1996 quarterly inspections of Pond 002. <br />Measurements of selected physical parameters of the pond were made with an Abney level, Philadelphia rod, <br />cloth tape, and compass. <br />Chimney Rock Mine Pond #002 Certification, 3 December 1996, Page 2 of 3 Pages <br />1 <br />
