<br />ANNUAL REPORT"_ <br />INSTRUCTIONS <br /> <br />According to C.R.S. 34-3'_-116t=>. and C.R.S. =4-33.E-1 16(31(a), on the annivers[uy date of the permit each year, <br />the operator shall submit a report and a map showing the extent of current disturbances to affected I.md. <br />rec]amation accomplished to date antl during the preceding year, new disturbances that are anticipated to occur <br />during the upcoming year, and re~aamation that will 6e performed durins the upcoming year. Please attach such <br />a report and map to enclosed annual report form. (An adequately labeled map that clearly delineates and includes <br />the above elernen[s may suftice fc+r a written report.) <br />If your operation is subject to the provisions of Temporary Cessation as detined in the Act and Rules, you must <br />provide with the Annual Repor the following information as required by 2 CCR '0?-l, 407-4, and Rules <br />(I} the condition of the opena:ion at the time of cessa:icn: <br />(ii) what specific measures have been and will be implemented to comply with reclamation. <br />performance standards and Environmental Protection Plan requirements, if [hey are pan of your <br />approved application; and <br />(iii) plans for resumption of Honing operations. <br />Please provide the additional following information with your Annual Report, as applicable: <br />(a) Per the requirements c•f 2 CCR •307-1, 407-4, and Rules I .I 7(1), provide an updated statement <br />regazding the sufficiency of thc. value of the Financial Warranty, specifically: <br />(I) Per the requirements o[ 2 CCR 407-1, 407-4, and Rules l.li(1)(a), provide an updated <br />statement re,arding the sufficiency of the value of the financial watTanty. Specifically, <br />irrevocable letters of credit, Deeds of Trust. and security aereements, self-insurance, salvage <br />credit, and first priority liens on project related fixmres. <br />(ii) Per the reyuirements of 3 CCR 407-1.407-3, and Rules ].ld(I)(bj, permits secured with a <br />Deed of Trust or a Security Agreement, the operator shall submit are update, by a qualified <br />independent appraiser, indicating any chances in progeny value, and a statement summarizing <br />any circumstances which may affect the adequacy of [he Deed of Tmst, or Security Agreement, <br />and the value of the property subject to either of these ins-wments. <br />The report shall also provide proof that there are no past-due property taxes. <br />(iii) Per the requirements of '_ CCR 407-1, 407-4, and Rules =i.7(3j, permits secured with an <br />Irrevocable Leger of Credit, the operator shall have the bank provide documentation in [he form <br />of a balance sheet, certified by a Certified Public Accountant, demonstrating [hat the <br />Le[[er of Credit does nut exceed ten percent (104'e) of the bank's capital surplus accounts. <br />(vi) Per the requirements of 2 CCR 407-1.407-4, and Rules 4.9.3(c), permits secured by a First <br />Priority Lien on any fixtures and Equipment. the operator shall provide a report in sufficienr <br />detail to fully describe the condition, value, and location of all pledsed fixtures <br />and equipment. <br />(bj Per the requirements of 3 CCR 407-], 407-4, and Rules ].ld(1)(c), all monitoring infotmtanon <br />required as part of the approved permit application, to include [he Environmental Protection Plan. <br />iPeease note thaz if you are not a Desienated Mining Operation, you will not have an Environmental <br />Protection Plan as part of your approved permit.) <br />
