Walker Ronald W. Catlany
y Division DIreCIOr
subject: Review of 151 Quarter 2004 Inspection Report, Foidel Creek Mine, C-1982+#i5>C~e~urGe rruscee
date: July 7, 2004
Rule 4.09.1(11)(a) The fill shall be inspected for stability by a registered engineer or other
qualified professional specialist experienced in construction of earth and rockfill embankments
under the direction of a qualified professional engineer at least quarterly throughout the
construction and during the following critical construction periods: (1)removal of all organic
material and topsoil, (2)placement of underdrainage systems, (3) installation of surface drainage
systems, (4) placement and compaction of fill materials, and (~) revegetation.
The subject inspection was a quarterly inspection accomplished throughout construction, not one
of the critical construction periods. The report does not specifically state that a registered
engineer or other qualified professional specialist made the inspection, but infers such by
certification under a company letterhead. This was raised as an adequacy issue with the operator.
Rule 4.09.1(11)(b) The qualified registered engineer shall provide to the Division a certified
report within 2 weeks after each inspection that the fill has been constructed as specif ed in the
design approved by the Division. The report shall include a description of any appearances of
instability, structural weakness, and other hazardous conditions observed during the inspection.
A copy of the report shall be retained at the mine site.
The site was inspected on February 6, 2004, and again on March 30, 2004. It was received at the
Division of Minerals and Geology (Division) on June 4, 2004. The report was over due by some
66 days. There have been personnel changes and perhaps changes in duties during this time
frame that may have contributed to this delinquency. This issue was brought to the attention of
the operator as an adequacy item.
Appearances of instability, structural weakness and other hazardous conditions were not related
in the report. The omission was brought to the attention of the operator as an adequacy item.
Rule 4.10.1(1) All coal mine waste shall be transported and placed in new and existing disposal
areas approved by the Division for this purpose. These areas shall be within a permit area. The
disposal area shall be designed, constructed, inspected and maintained:
Office of Office of Colorado
Mined Land Reclamation Ac[ive and Inactive Mines Geological Survey
