Approximately 79 acres are reported as backfilled, graded, <br />topsoiled and seeded in 2000 (letter of Mazch 9, 2001). The locations of 10.7 acres in the vicinity <br />of the West Pit, 68.3 acres in the vicinity of [he East Pit, and no acres in the vicinity of the Section <br />16 Pit are identified in the Colowyo letter of March 9, 2001 and are illustrated on Exhibit 9 of the <br />report. However, only identification of 10.1 acres was found on Exhibit 9 for the West Pit area. The <br />operator was asked to reconcile this discrepancy by adequacy letter of January 24, 2002. <br />Rule 2.04.13(1)(d): Location and number acres topsoiled during that year; <br />The report is in compliance with this rule. See the review under rule 2.04.13(1)(c) above <br />Rule 2.04.13(1)(e): The species, location and number of acres of vegetation planted during that <br />yenr, including any augmented seeding or cultural practices; and <br />The report is in compliance with this rule for the location and number of acres of vegetation planted <br />during 2000 [see review under rule 2.04:13(1)(c) above]. The report is incompliance by reference <br />with this rule for the species (reported as the seed mixture approved in the Permit). Such species are <br />identified on pages 2.05-44 and 2.05-46 of the Permit. The Permit provides for bare root plantings <br />as well (page 2.05-52). The letter (Mazch 9) in the report describes containerized planting. One shrub <br />_ establishment area is reported in a Section 16 pit area in a "1999 B". Another was the Colorado State <br />University and Division demonstration project. Both aze shown on Exhibit 9. <br />Rule 2.04.13(1)(f): Location, number of acres and date of planting for all previously revegetated <br />areas. <br />The report is in compliance with this rule. The location, number of acres and date of planting for <br />all previously revegetated azeas is illustrated on Drawing No. Exhibit 9 of the report. <br />Rule 2.04.13(2): The permittee may provide additional monitoring information as required by the <br />approved permit. <br />The report is in compliance with this rule. <br />Sampling of Overburden (Topsoil) <br />Sampling of overburden is introduced on page 2.05-9 of the Permit. The Permit (page 2.05-57) <br />requires a random sampling of topsoil. The density of sampling of regraded overburden is one <br />sample per five acres (Permit, Exhibit 6, Section 4b, Colowyo letter of January 4, 1983). The <br />report (Exhibit 8) includes analyses of the regraded overburden sampling program.
