Dept. of Natural Resources <br />Following is an amendment to the Christian Pits operated by Schmidt-Tiago <br />Construction Company. This amendment was ultimately precipitated by the <br />• preparation of annual reports for these pits. Early in 1982, Schmidt-Tiago <br />realized that annual reports had not been prepared for the EI Paso County <br />operations. In the process of preparing the annual reports, it became <br />evident that several complex problems existed on the Christian Pits. The <br />problems were brought to the attention of Mark Loye and he suggested an <br />amendment be prepared to correct the difficulties. This amendment will, <br />hopefully, correct these problems and in the future, make the operation of the <br />gravel pits much more easily accomplished. <br />Details of the history and nature of the problems can be found in the annual <br />reports. In outline, the problems include mining beyond the converted permit <br />boundaries but within the 1974 permit boundaries; a bond reduction that is very <br />difficult to reconcile with permit boundaries; and reclamation ac ti vites on the <br />mines; and a condition of probable underbonding as a result of the bond reduc- <br />tion. The problems appear to be a result of confused permit implementation on <br />the part of Schmidt-Tiago as well as apparently erroneous recommendations by <br />~, the staff of the Mined Land Reclamation Board that resulted in improper Board <br />actions. In effect, the problems were created by a combination of several <br />different actions taken by Schmidt-Tiago and the Board's staff. Ultimately, <br />it appears, the problems arose because neither the operator not the Division <br />were fully aware of what was required to be done. <br />This amendment does several things. First, it includes, through the addition <br />of 284 acres to the existing permitted acreage, all the land that is currently <br />anticipated to be mined in the life of the mine.
