<br />`J <br />Anthony J. Waldron December 1, 1995 <br />Re: 1995 Annual Reclamation Report <br />Company is currently investigating opening a new portal <br />in the Bear Canyon drainage. Somerset Mining Company's <br />approved backfilling and grading plan left a fairly <br />large bench in place along the Bear Canyon access road. <br />This bench could be utilized by our future coal mining <br />operations. The proposed reclamation plan backfills <br />the bench and leaves only a narrow road in place." <br />By a letter dated September 1, the Division notified <br />Pacific Basin Resources, the successor to the permit as <br />of August 31: "Since there is a formal objection to the <br />Division's decision to approve TR-23, the revision <br />approval is not yet final and work should NOT proceed <br />at this site." Since it was late in the construction <br />season, on September 5, an application for a minor <br />revision to delay the completion of the Bear Creek <br />reclamation until 1996 was submitted. Minor Revision <br />No. 32 was approved on September 18. <br />However, some of the work planned for the Bear Creek <br />site was intended to stabilize the toe of the slope and <br />reconstruct the Bear Creek stream channel. Concerned <br />with potential slope failure during the spring runoff <br />in 1996, Pacific Basin Resources requested permission <br />to proceed with part of the backfilling and grading. <br />After discussions with the Division, an application for <br />a minor revision to allow the Bear Creek stream channel <br />repair was submitted October 6, and Minor Revision No. <br />33 was approved on October 11. The Bear Creek stream <br />channel repair work was completed on October 24. Also, <br />the concrete foundations demolished in 1994 and the <br />portal structure on the east side of Bear Creek were <br />buried against the slope in October. Actual acreage <br />backfilled and graded to possible final reclamation <br />contours, depending on any further changes resulting <br />from a Board Hearing decision, was approximately 0.25 <br />acres. <br />On July 21, an application for a minor revision was <br />submitted to revise the specified reclamation dates for <br />the Upper and Lower Hubbard Creek sites and the power <br />line and power line road. The reasons for the revision <br />included expected cost of the Bear Creek reclamation <br />work, the Bureau of Land Management request in a <br />December 5, 1994 letter to assume responsibility for <br />the power line road, and the potential development of <br />additional coal properties in the area. The delay in <br />the reclamation schedule will allow time for these <br />7 <br />
