' Banks and Gesso, LLC <br />spread the cost of remediation over this time frame. <br />First, ASCI proposes to start gravel mining activity in uncontaminated <br />areas, pursuant: to the remedial plan described previously. Areas with <br />toxaphene soil contamination is excess of the unrestricted use <br />concentration (0.40 mg/kg or less) will not be disturbed by mining until <br />approval from CDPHE is obtained, and mining will occur no closer than <br />50-feet from such areas (see Figure 2). <br />' Area 1 of the proposed mine site (see Appendix 6 - DMG permit) has <br /> been examined and tested and we believe the contaminated areas are <br /> confined to other parts of the property (i.e. contaminated above state <br />standards). ASCI believes it can safely mine Area 1 without disturbing <br /> contaminated soils. There is no indication of contaminated soils on the <br /> property other than what we have identified. No mining activity shall take <br />' place unless tho toxaphene concentration is equal to or less than 0.40 <br /> mg/kg. If concentrations are above this level remedial action will take <br />' place as previously described. <br /> The final phase of mining involves removing the structures on the property <br /> and mining the sand and gravel beneath them (and in the surrounding <br /> area). At this point in time surface soil sampling, as described in this <br /> application, will occur and remedial action, as necessary, will be <br /> implemented. Some of the structures have concrete floors so it is not <br /> anticipated that significant contamination will be present beneath the <br /> buildings. <br /> <br /> 6.0 Clean Ua Completion Report <br />' A Clean Up Completion Report will be prepared and submitted to CDPHE after <br />all remedial activities have been completed.
