April !4, 2006
Mr. Byron Walker
Re: 2005 Annua! Reclamation Report -Adequacy Comment Responses
Page 2
In Tab 23, Bonding, of the approved application package, on page 4, the Miscellaneous Utilities
subsection indicates that underground utility reclamation, including water lines, will be to abandon
in place. As suggested in the Adequacy Comment letter, backfilling and grading work was
concurrent with installation of the pipeline, and therefore, complete. The reseeding work completed
in 1978/1979 is also permanent -the replacement of the existing, well established vegetative cover
would be counterproductive. To reflect that the seeding is permanent, HGTI has revised the
CDMG's report form to show that 1.4 acres were seeded in previous years. Please note that the
column title corrections suggested by yourself in a letter regarding the Hayden Gulch Mine 2006
Annual Reclamation Report dated March 17, 2006, were incorporated into the revised CDMG report
form submitted herewith.
The HG Shallow Well is a permitted well (Permit No. 24567-F) with an adjudicated water right
(Case No. 80CW94, decree date of April 17, 1981). Following termination of Loadout operations,
this water right will be conveyed to HGTI's parent company as augmentation water for other
operations. At the time HGTI determines the well is no longer needed to support operations at the
Loadout, or other site, the well will be abandoned in accordance with Division of Water Resource
regulations.
Attached, please find the revised report form and amended drawing. They supplement the material
submitted to CDMG on February 16, 2006. If you have any questions, please don't hesitate to
contact the undersigned.
Sincerely,
Hydro-Environmental Solutions, Inc.
(on behalf of Hayden Gulch Terminal, Inc.)
J n Weinman
Project Manager
attachment
cc: Brian Dunfee, Peabody Energy
Hydro-Environmental Solutions, Inc.
P.O.Box 772996
57 !dN Street, Suite B
Steamboat Springs, C080477
970-871-6/25
