Inc. hydrotogy, water quality and April 14, 2006 Mr. Byron Walker Colorado Division of Minerals and Geology 1313 Sherman Street, Room 215 Denver, CO 80203 Re: Hayden Gulch Loadout Permit C-92-081 2005 Annual Reclamation Report Adequacy Review Reponses Dear Mr. Walker; via Certified Mail 70051820000305272154 ^.inn ~ /~'~~ ANk 17 2006 Division of Mlnemis and Geolopr Hayden Gulch Terminal, Ina (HGTI), the permittee for the above referenced permit, is in receipt of Colorado Division of Minerals and Geology's (CDMG) letter dated February 22, 2006, regarding the adequacy review for the 2005 Annual Reclamation Report (2005 ARR). CDMG's letter indicates HGTI should revise the 2005 ARR to clarify disturbance and reclamation for the HG Shallow Well and associated water supply pipeline. The Adequacy Review letter included an accompanying memorandum that described CDMG's review of the 2005 ARR with respect to Rule 2.04.13. The memorandum noted that the 2005 ARR was received by CDMG on February 17, 2006. CDMG's comment suggests that this submittal date is not in compliance with Rule 2.04.13(1). The rule reads, "By February 15, or other such date as agreed on, each permittee shall file an annual reclamation report covering the previous calendar year for all areas under bond." In Tab 20, Revegetation Plan, of the approved permit application package, on page 11, under the Annual Reporting subsection, the text states "The Annual Reclamation Report will be submitted by March 30 of the year following reclamation or activity monitoring..." Consequently, HGTI is in compliance with Rule 2.04.13(1). As noted above, CDMG has requested HGTI revise the annual hydrology report to identify disturbance associated with the HG Shallow Well and associated water supply pipeline. Drawing 1, Affected Lands, has been amended to show there is a historical disturbance associated with the HG Shallow Well and associated water supply pipeline. The amended drawing is attached to this letter. The well and pipeline were constructed by the previous owner/operator/permittee - H-G Coal Company. The limited information HGTI has been able to find on the two features in the project file indicates they were constructed in the 1978/1979 period. The available information does not include design specifications or construction details. Consequently, HGTI is unable to accurately delineate the extent of disturbance (acres) or identify the nature of the reseeding (dates), however, if we assume the corridor disturbance averages 15 feet wide, the extent of disturbance is estimated at 1.4 acres. coasu/ting services P.O.
