CDMG's letter <br />indicates HGTI should revise the 2005 ARR to clarify disturbance and reclamation for the HG <br />Shallow Well and associated water supply pipeline. <br />The Adequacy Review letter included an accompanying memorandum that described CDMG's <br />review of the 2005 ARR with respect to Rule 2.04.13. The memorandum noted that the 2005 ARR <br />was received by CDMG on February 17, 2006. CDMG's comment suggests that this submittal date <br />is not in compliance with Rule 2.04.13(1). The rule reads, "By February 15, or other such date as <br />agreed on, each permittee shall file an annual reclamation report covering the previous calendar year <br />for all areas under bond." In Tab 20, Revegetation Plan, of the approved permit application <br />package, on page 11, under the Annual Reporting subsection, the text states "The Annual <br />Reclamation Report will be submitted by March 30 of the year following reclamation or activity <br />monitoring..." Consequently, HGTI is in compliance with Rule 2.04.13(1). <br />As noted above, CDMG has requested HGTI revise the annual hydrology report to identify <br />disturbance associated with the HG Shallow Well and associated water supply pipeline. Drawing 1, <br />Affected Lands, has been amended to show there is a historical disturbance associated with the HG <br />Shallow Well and associated water supply pipeline. The amended drawing is attached to this letter. <br />The well and pipeline were constructed by the previous owner/operator/permittee - H-G Coal <br />Company. The limited information HGTI has been able to find on the two features in the project <br />file indicates they were constructed in the 1978/1979 period. The available information does not <br />include design specifications or construction details. Consequently, HGTI is unable to accurately <br />delineate the extent of disturbance (acres) or identify the nature of the reseeding (dates), however, if <br />we assume the corridor disturbance averages 15 feet wide, the extent of disturbance is estimated at <br />1.4 acres. <br />coasu/ting services <br />P.O.
