Annual Certification <br />Rule Number 4, Section 4.05.9 (10) and (11) <br />The basis for this section of this certification is Rule Number 4, Section 4.05.9 (10) and (11) of the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. References within this <br />certification quote Rule Number 4 ualess otherwise noted. <br />(a) F~dstine and required monitorine procedures end instrumentation. <br />Inspections of the pond are required quarterly [Settion 4.05.6(13)]. Quarterly inspections were made on <br />325194, 623/94, 9/30/94, and 7 November 1994. <br />There is no existing or required instrumentation. <br />Ib) The deslen depth and elevation of env impounded waters at the time of the initial ttrtitication report or <br />the averaee and maximum depths end elevations of env impounded waters over the past veer for the annual <br />certification reports. <br />Based on the quarterly inspection reports over the past year (325/94, 623N4, 9/30/94, and 7 November 1994), <br />the average depth and elevation of impounded waters was 0.5' and 6453.5, and the maximum depth and <br />elevation was 1' and 6454.9', respectively. <br />j~ Eadstine stotaee capacity of the dam or embankment. <br />The existing storage capacity of the dam is estimated to be approximately 0.84 acre feet [from [he existing <br />sediment level to the invert of the principal spillway (reference the Sedimentation Pond As-built, Rev. 1, 5-30- <br />91), and 4th Quarterly Inspection Report]. <br />(d) Anv fires occurrine in the construction material up to the date of the initial certification or over the past <br />year for the annual certification reports. <br />No fires were reported up to the date of the initial certification, and no indigtion of Gres in the construction <br />materials of the dam was observed during the past year. <br />(el Anv other aspect of the dam or embankment affectlne stability. <br />Burrowing by rodents (in conjunction with impounded water) has an adverse impact on the stability of the <br />dam.
