these seeded areas plus the area disturbed during the reclamation of sub-area 1 show vegetative <br />gowth. The topsoil and sub-soil piles along with the pond and other disturbed areas associated with <br />pit Sa that were seeded last fall are showing signs of growth. All organic material and topsoil was <br />removed prior to the storage of refuse in all areas. Sub-area 1 has been reclaimed and is no longer <br />in use. <br />To the best of my knowledge, based on my professional expertise, the permanent refuse structures <br />at the Deserado mine are being constructed in conformance with the prudent state-of--the-art <br />construction practices as they relate to coal processing waste bank construction.
