Specifically, TCC is responding to the issues raised in the fourth paragraph of page three, which has a time limit of April 30, 1986 by which to formulate and submit such responses. The enclosed responses are associated with the activities planned, approved, and conducted under Fish Creek Tipple Permit No. C-036-81, in light of the fact that the 1985 Annual Hydrologic Report referenced in your letter, could only be associated with the Fish Creek Tipple. TCC's 1985 Annual Hydrologic Report for the Foidel Creek Mine, Permit No. C-056-82, is planned to be submitted to your office no later than April 30, 1986. The issues as addressed in your letter are followed by our response to each. 1 - TCC's preliminary written opinion on the source of elevated TDS in the affected drainage. Response As can be seen from the attached map Fish Creek Tipple Areas of Possible Subirrigation and Water Rights, the activities planned, approved and conducted at the Fish Creek Tipple are downstream of Foidel and Middle Creeks, the drainages of concern as addressed in your letter. Therefore, it is TCC's opinion that the source of elevated TDS in the Foidel and Middle Creek drainages can not be attributed to the past, present or future activities at the Fish Creek Tipple as approved under Permit No. C-036-81. c~RUs
