1996 Annual Hydrology Repor/ Responses <br />December 11, 1997 <br />Page 8 <br />discussions in the permit on mine water routing and lumping in the Probable <br />Hydrologic Consequences (PHC), TR#80. (See also responses to MR#208). <br />.Although requested afrer the end of the 1996 Water Year, MCC did provide <br />all laboratory data sheets with the 1996 AHR. Discussion regarding future <br />submittal of laboratory data sheets and submittal ofchain-of-custody forms is <br />contained in the responses to MR#208. <br />.Again, this request was made afrer the 1996 Water Year; therefore, this <br />information was not included in the 1996 AHR. MCC will include anion and <br />cation balances in the 1997 Water Year AHR. See also responses to MR#208. <br />Based on the fact that all of the above items were requested afrer the end of the <br />1996 Water Yeaz, MCC would like the Division to reconsider the issuance of <br />the NOV. In addition, the NOV should be reconsidered because the Division <br />did not specify a date in which the incompleteness issues For MR#208 were to <br />be addressed. MCC was in compliance with the monitoring program as <br />presented in the currently approved permit for the 1996 Water Yeaz. <br />With the submittal of these responses and with the submittal of responses to MR#208 <br />on December 5, 1997, MCC expects that the NOV will be abated, and furthermore <br />believes that the NOV was unjustly issued and seemingly arbitrary and capricious <br />and requests that the NOV be vacated.
