This <br />construction materials operation is conducted under a lease agreement for the mining of sand <br />and gravel that was executed by and between the private landowner, Rocky Mountain Ranch, <br />LLC, and Jackson County. A total of twenty-four (24) yards of material was removed from <br />the Riley Pit during 1999. <br />The Riley Gravel Pit was inspected by Erica Crosby of the Colorado Division of Minerals <br />and Geology on July 29, 1999. Ms. Crosby stated in her inspection report that "the pit <br />extends nearly the entire fence line, depicting the lease boundary. Based on rough field <br />measurements (pacing), the pit appears to be slightly larger than the approved 3.844 acres. <br />The County stated that the affected area would be surveyed to determine the actual size of <br />the pit. The operator agreed to inform the Division of the results of the survey. Depending <br />on the results of the survey, afollow-up inspection may be required." On August 11, 1999, <br />I informed the Division that the County was having the gravel pit re-surveyed and addressing <br />the problems found when inspected on 7/29/99. Preliminary survey results indicated that the <br />perimeter fence extended outside the permitted acreage and that there probably had been <br />limited overburden removal outside the permitted acreage (SEE ENCLOSED SCHEMATIC <br />CONTOUR MAP OF RILEY GRAVEL PIT). I contacted the ranch manager for the private <br />landowner and asked if he would contact the owner to obtain his approval to expand the lease <br />area so that Jackson County could then finalize the survey to get a new legal description of <br />lands to include in the lease agreement and for filing a permit amendment to expand the <br />permitted acreage. The private landowner approved an enlargement of the lease area, and <br />we requested the surveyor to prepare a plat and legal descriptions that would give Jackson <br />County options on the size of lease area and the area to be added into the permitted acreage <br />through a permit amendment. <br />
