Burden of Proof Requirements <br />The permittee has the burden of proof when seeking relief from total suspended solids (TSB), total iron, and/or settleable solids <br />(SS) limitations. Relief may be granted separately for each dischazge occurrence only when necessary and shall not be granted <br />when the permittee has control over the discharge. The permittee should endeavor to meet the primary limtations whenever <br />possible. The permittee will need to show that exceedence of the applicable ]imitations were caused by.precipitation and no outer <br />source and that the dischazge was beyond their control. Manualdewatering of Ore ponds shall meet TSS and total iron litnitatians <br />unless it is the only method of dewatering. In such cases, manual dewatering is eligible for alternate limitations as is automatic <br />dewatering and the following demonstrations shall apply. <br />a) For rainfall: to waive TSS and total iron limitations, it is necessary to prove that discharge occurred within 48 hours after <br />measurable precipitation has stopped. In addition, to waive settleable solids limitations; it is necessary to prove that discharge <br />occuned within 48 hours after precipitation greater than the ]0-year, 24-hour, event has stopped. <br />b) For snowmelt, to waive TSS and total iron ]imitations, it is necessary to prove that discharge occurred within 48 bows after <br />pond itttlow has stopped. In addition, to waive setileable solids limitations, it is necessary to prove that dischazge occurred <br />within 48 hours after pond inflow volume greater Oran the 10-year, 24-hour event has stopped. <br />Should a precipitation event or snowmelt occur, the perznittee shall submit adequate proof in order foran exemption to be claimed. <br />Said proof shall be submitted as an attachment to the Discharge Monitoring Report (DMA) for,.tht appropriate period. The <br />Division shall detentrine the adequacy of proof. As part of this determination, the Division shall evaluate whether the permittee <br />could have conttolled the discharge in such a manner that primary limitations could have been met. ~, <br />3. Whole Efllvent Toxiciri Testine Requirements -Chronic WET Testinl?-Outfalls 003. 022, and 024 <br />(a) Testing and Reorting Reouirements <br />Test results shall be reported on the Discharge Monitoring Report {DMR) submitted for the reporting period during which Ore <br />sample was taken. (i.e., WET testing results for the calendaz quarter ending March 31 shall be reported with Ore DMR due <br />Apri128.) The results shall also be submitted on Ore Chronic Toxicity Test report form, available from the Division. Copies <br />of these reports are to besnbmitted to both the Division and EPA alotrg with the DMit <br />The pennittee shall conduct each chronic WET test in general accordance with methods descnbed Short Tenn Methods Sox <br />Estimating the Chronic Toxiciri of Effluents and Receiving Waters to Freshwater Organisms, EPA/600/4-89/001 or most <br />current editions, except as modified by the most tortoni Division guidance document entitled Guidelines for Conductinr <br />Whole Ellluent Toxiciri Tests. The permittee shall conduct such tests using Ceriodaphnia dubia and fathead minnows. <br />
