In considering whether the requested permit shall be approved the provisions of C.R.S.
37-9Q137(4) and the Denver Basin Rules shall apply. Withdrawals shall be allowed on
the basis of an aquifers life of 100 years, C.R.S. 37-90-137(4)(b)(I).
' 12. The quantity of water in the aquifer, exclusive of artificial recharge, underlying fhe
788.54 acres of land described in Exhibit A is 18,925 acre-feet. This determination was
based on the following as specified in the Denver Basin Rules:
' l
th
d
i
d
I y
er
ng
e lan
a) The average specific yield of the saturated aquifer materials un
under consideration is 15 percent.
' b) The average thickness of the saturated aquifer materials underlying the land
under consideration is 180 feet.
13. A review of the records in the State Engineer's office has disclosed that there are
existing wells or other water rights withdrawing ground water from the aquifer
underlying the land Gaimed by the applicant. The well permit numbers, rates of
withdrawal, and other relevant data concerning such tights are as follows:
' Permit No. Location Annual Withdrawal
183483 SE 1l4, SE 1l4, Sec. 25 3 AF/yr
Twp. 3 North, Rge. B4 West
75493 SW 1/4, NW 1/4, Sec. 36 1 AFlyr
Twp_ 3 North, Rge. 84 West
24651-F NW 1/4, NW 1/4 Sec. 25 Abandoned
' Twp. 3 North, Rge. 84 West
24850-F NE 1/4, SE 1/4 Sec. 25 Abandoned
Twp. 3 North, Rge. 64 West
To prevent material Injury to such vested water rights, the quantity of water underlying
' the land claimed by the applicant which is considered available for withdrawal has been
reduced to 18,525 acre-feet. This reduction was based on a calculation of the quantity
of water underlying such lands as would be sufficient for the persons entitled to
' withdraw water under existing rights to withdraw the average annual amount of water
from the aquifer for the minimum useful life of the aquifer (100 years).
14. Based on the above, the State Engineer finds that there is water available for
' withdrawal by the proposed well and no material injury to vested water rights would
result from the issuance of the requested permit subject to the following conditions:
' a) The allowed average annual amount of water to be withdrawn from the aquifer
by the well shall not exceed 185 acre-feet (the quantity of water which has been
requested by the applicant}.
t b) The well shall be wnstn, cted no more than 200 feet from the location specified
on the permit application.
' c) The applicant shall submit geophysical and lithologic logs after the construction
o} the well. The geophysical logs shall be obtained from the hole before the
casings are installed.
'
d) The maximum pumping rate of the well shall not exceed 100 gallons per minute.

1
