Lochhead <br />4ecutive Director <br />Michael B. Long, <br />Division Director <br />Thank you for the letter of June 28, 1996 regarding the mine water <br />inflow situation. We are concerned that Mountain Coal Company <br />continues to encounter water inflows. We will be evaluating the <br />situation in detail as we review the recent Annual Hydrology Report <br />submittal. <br />It is likely that additional permit work will be required in the <br />near future. The existing permit documents and probable hydrologic <br />consequences materials may require significant updates. It appears <br />that specific issues including the long term use of underground <br />sumping, groundwater impact analysis, water rights impact <br />implications, geotechnical stability, surface water quality and <br />pond management, and long term water accumulation relative to mine <br />closure must be reviewed to ensure ongoing compliance. <br />The letter of June 28, 1996 indicates that Mountain Coal Company <br />may use explosives underground at the fault location in an attempt <br />to divert mine inflows from the No. 2 entry, to the Zero entry. <br />Please ensure that any such activities are conducted in full <br />compliance with all explosives permitting requirements, as well as <br />in full consideration of the potential for unsafe inflow <br />conditions. <br />We appreciate your ongoing updates regarding the inflow situation. <br />Please call with any questions. <br />Sirye~rely, <br />G <br />pav' Berry <br />Se 'or Environ tat <br />c: Boulay <br />McCannon <br />Protection Specialist <br />
