BLMiUSFS ID :700-322-7261 SEP 28 '94 13 :23 No .004 P .09 <br /> have been received for the Lion Canyon mines. <br /> Sal Venticinque's (BLN Grand RA, Utah) records show Doug Cleghorn filed a 1990 <br /> NOI which specifies Lion Canyon Road in maintained by Montrose County. <br /> 09/16/94 I called county road foramen Dirk Richard to ask if Montrose County has <br /> Lion Canyon Road on their maintenance schedule. He said that it was not; nothing <br /> in his records indicated the road had been abandoned and turned back to BLM. <br /> 0/19/94 A Mine Safety and Health Administration's Grand Junction, contact said <br /> that when are was being taken froo the mines the road did not meet MSHA standards <br /> and thought St. Patrick's operator, Cecil Bunker was asked to constructed safety <br /> cables and bermed the edge of the county road. They have authority only with <br /> productive mines; and would be involved in road safety issue if the Bkock/Blue <br /> Cap mine were to continue with underground mining activity. <br /> Talked to Jim Griendle (9/19/9W) of San Miguel Power and he said that he <br /> remembered the road historically being maintained by Montrose County. The power <br /> to the mines was supplied by San Miguel, The power poke and transformers are <br /> still present at the Utah mines (T 28S., R 263, Sections 28 and 29), and if the <br /> Black Hat/Blue Cap mines were abandoned, then the power would utilise Lion Canyon <br /> access road to transport their pales and transformers. <br /> Saint Patrick mine owner, Mika Moore, (303)-864-7814) returned my cull on <br /> September 19th and told me that ho had tried to take his loader in to the mine <br /> thin spring as he intended to do some additional stabilization work and wanted <br /> to check on his seedling survival. He was unable to negotiate the road and had <br /> to cons back down. He said that Doug Cleghorn (303) 243-0396 was no longer the <br /> operator of the Black Hat/Blue Cap and the mines along the West aide of Lion <br /> Creek had gone back to their Salt Lake City owners. <br /> Moore stated that he was responsible for his spur road and permitted area only. <br /> He had no joint maintenance responsibility for Lion Canyon Road. In regards to <br /> the mine reclamation, Moore recognized that although he did what he thought would <br /> be adequate storm water retention and diversion, the storm events had created <br /> unexpected erosion. I understool that he had also walked into the mine site. <br /> He was planning to call CMLRD to talk to Tom Schreiner about his permitted area <br /> and the situation with the Lion Canyon roadway. Moore feels that it is not his <br /> responsibility to repair the county road, and the fact that it is not drivable <br /> is restricting his ability to readdress his mine reclamation project. <br /> Moore recalled there was a water right on the spring went of his spur road and <br /> the spring often had to be maintained to keep it flowing. He wasn't sure who had <br /> done the maintenance. The epring'a pond overflow is primarily diverted under Lion <br /> Crook road through a 18" culvert. Water that is on the low edge of the pond is <br /> flowing down the road's barrow ditch, combining with waters from the St. Patrick <br /> Mine road, crossing the surface of the road and discharging over the bank about <br /> 10, east of the culvert outfall. <br /> John Davis and I checked water-right records at the District office, followed by <br /> search with Colorado Water Resou[ces Division. Local records didn't pinpoint a <br /> anything on the spring location. <br /> I talked to Doug Cleghorn, 621 26 Road Grand Junction, Colorado 81506 (303)-243- <br /> 0396. He said he had not been to the mine for several yearai the current owner <br /> of Black Hat/Blue cap is Keith Cannon. Mr. Cleghorn verified that while other <br /> road do exist that come "over the top" down to the mines, Lion Canyon road to the <br /> only feasible route. Several people I've talked to agreed that the roads were <br /> washed out or blocked by boulders. The consensus of opinion in Lion Canyon is <br /> the practical and historic accesa to the mines and was once county maintained. <br /> 09/20/94 Called Division of Oil, Gas and Mining (801)-538-5340. Janell Burns <br /> said 5-037-066 "Black Hat, Blue Cap" were purchased by Keith Cannon in 1992. His <br /> address is Lady Ann Company, 832 Northeiffe Drive Salt Lake City, Utah 84103 <br /> (801)534-0743. Annual reports of "no activity" were filed in 1991 and 1992 by <br /> Keith Cannon. Their records showing transfer of owner ship is incomplete and <br /> 1993 annual activity report hasn't been received. <br /> Wrote a letter to Montrose County Commissioner, Mel Statt, requesting emergency <br /> repair of the road by the county. <br /> I <br />
