Re: May Day Mine, Permit No. M-81-185, Annual fee and Report Request, Notice
of Violation No. M-92-072
Section 34-32-116(3 - 4) and 34-32-127(2), C.R.S. (1991 Supp.) and
Permit No. M-81-185 require you to submit a 5175.00 annual fee and an annual
report ON OR BEFORE September 5 of each year to the Division of Minerals and
Geology (the "Division"), for the previous years operations, until your
reclamation bond is released in its entirety. As of this date, the Division
has not received your annual fee and report for 1991-92. Therefore, you are
in violation of the above cited statutes and the provisions of your
Permit No. M-81-185. Pursuant to Section 34-32-124(7), C.R.S. (1984) you are
hereby 35ie552d a civil penalty in the amount of 3175.00.
If you fail to submit your annual fee, annual report and the civil penalty
assessed to you by the Division by November 30, 1992, the Division mill be
forced to turn this account over for collection to Central Collection Service,
for the State of Coicrado. 1•lhen :his action occurs, your account will also be
reported to TRtJ Credit Bureau as a "Collection" account. Simultaneously,
collection proceduresdill commence to collect this account.
If this matter is not resolved ~.vithin 90 days you will be scheduled for a
Formal Puelic Hearing before the Colorado t4ined Land Reclamation Board for
consideration of permit revocation and forfeiture of your 35,000.00 financial
warranty at the March 24-25, 1993 Board Meeting. In the event forfeiture
actions and permit revocation become necessary, you will be noticed by
certified mail as to the time and the place.
IN ORDER TO ,OVOID COLLECTION, POSSIBLE PERMIT REVOCATION, AND BOND FORFEITURE
ACTIONS, PLEASE SUBMIT YOUR 'x175.00 ANNUAL FEE, THE 3175.00 CP1IL PENALTY (FOR
A TOTAL OF '5350.00), AND YOUR ANNUAL REPORT BY NOVEMBER 30, 1992.
