(1991 Supp.) and <br />Permit No. M-81-185 require you to submit a 5175.00 annual fee and an annual <br />report ON OR BEFORE September 5 of each year to the Division of Minerals and <br />Geology (the "Division"), for the previous years operations, until your <br />reclamation bond is released in its entirety. As of this date, the Division <br />has not received your annual fee and report for 1991-92. Therefore, you are <br />in violation of the above cited Statutes and the provisions of your <br />Permit No. M-81-165. Pursuant to Section 34-32-124(7), C.R.S. (1984) you are <br />hereby assessed a civil penalty in the amount of 3175.00. <br />If you fail to submit your annual fee, annual report and the civil penalty <br />assessed to you by the Division by November 30, 1992, the Division will be <br />forced to turn this account over for collection to Central Collection Service, <br />for the State of Colorado. When this action occurs, your account will also be <br />reoorted to TRW Credit Bureau as a "Collection" account. Simultaneously, <br />collection procedures will commence to collect this account. <br />If this matter is not resolved within 90 days you will be scheduled for a <br />Formal Public Hearing before the Colorado Mined Land Reclamation Board for <br />consideration of permit revocation and forfeiture of your 35,000.00 financial <br />warranty at the March 24-25, 1993 Board Meeting.
