On April 15, 1987, the <br />?•; ^lr' "^••~!:~ ~_~^:_:~inn n.-c~ aff or ~nV1eW Tnd aDArOV31 bV -the <br />•.v1v~u~i.i L~F.artW~=n~ '~r v""'~ t~:, _-~:lcd _ n....a_ F_ .+.an of noS ;_r!~~t;!ln <br />for an Ash Disposal Site, and Special Use Permit, allowing the site <br />to be used as an ash disposal landfill (See Attachment F hereto). <br />Further, the Mined Land Reclamation Board ("Board") has <br />allowed CEC to amend its CSCMRA Permit so that the reclamation plan <br />allows use of the property as an ash disposal facility for a period <br />which may take up to "forty years", after which the land will be <br />returned to grazing. (See Attachment G hereto). The Colorado <br />Department of Health, Air Pollution Control Division, issued an <br />Emission Permit to CEC on March 29, 1990, for flyash disposal. <br />(See Attachment H hereto). <br />The property is currently being used as an ash disposal <br />landfill under the jurisdiction and approval of applicable <br />governmental entities, including the Department of Natural <br />Resources' division of Minerals ~ Geology ("M&G") and Weld County. <br />?t is nn longer used for coal mining and will not be used for coal <br />mining in the future. <br />• B. Reclamation of the Site from a Coal !Sine to hll i+,ar. <br />Disposal Facility has Been Completed <br />CEC views its.past, present and future activities on the site <br />as divisible into five phases: <br />Phase Activity <br />1. Use of the site as a coal mine; <br />2. Modifying the site to accept ash disposal <br />,~ consistent with requirements established by the <br />Board of County Commissioners of Weld County and <br />other applicable authorities; <br />' 3. Reclamation of the site to the extent feasible and <br />' consistent with the post-mining use of the site as <br />an ash disposal facility; <br />4. Use of the property as an ash disposal facility for <br />an indefinite and potentially ?.ong period of time; <br />and <br />• ~ 5. Eventual restoration of the ash disposal facility <br />to grazing land (or such other post-landfill land <br />use as may be deemed appropriate at that time). <br />
