As you are aware, all mining activities were suspended at the end of <br />January, 1993 and reclamation activities were initiated. During 1994 backfilling, regrading, drainage <br />control, topsoiling, and seeding in the 720 Pit and associated overburden stockpile areas were completed <br />in accordance with the approved plan. In addition, backfilling, backsloping, and regrading were <br />completed in Pit 1 in accordance with the approved plan, however, drainage control, and topsoiling <br />were deferred pending resolution of OSMRE concerns. Based on the most recent mutual discussions <br />among Kerr, the DMG and OSMRE, some supplemental backfilling and regrading may be required in <br />the Pit 1 area to resolve AOC concerns and obtain Phase 1 bond release. <br />1.0 MINING AND TOPSOIL REMOVAL <br />There was no disturbance associated with active mining during 1994. The 720 pit and Pit 1 have been <br />inactive for some time. <br />No topsoil was removed in 1994. <br />2.0 BACKFILLING AND REGRADING <br />Material remaining in the existing overburden stockpile (OB-2) was removed and placed as final backfill <br />in [he 720 Pit and both areas were regraded to a configuration approximating the approved postmining <br />topography by March 1994. As a result of the DMG/OSMRE Phase 1 bond release inspection in May <br />1994 and completion of surveys of the regraded areas, some remaining spoil material was identified on <br />the margins of the former overburden stockpile area and it was determined that limited slope areas <br />exceeded final slope design criteria. As a result of these determinations, an additional 150,000 cy of <br />spoil material was removed from the former overburden stockpile area and placed along the base of the <br />regraded slopes in the 720 Pit area and portions of the final slope were regraded to achieve the approved <br />postmining configuration.
