The staff does not <br />understand the confusion you have over this issue. Since a technical <br />revision had been filed for this operation identifying the new area to be <br />mined and the new mining direction, the staff feels the operator <br />understands the necessity for changiny the permit documents Ito reflect <br />the above changes. Hopefully, the following discussion will clear up any <br />uncertainties. I <br />For any permit application, a specified start and stop point ,; as well as <br />a direction of mining, must be delineated. This assists the bperdtor, <br />any interested entities, and the staff in determining how the mining plan <br />and reclamation plan will he implemented and interact. Basedjon this <br />interpretation, a permit application is or is not approved. Unce the <br />permit has been approved, any changes to the mining or reclamation plans <br />is a violation of that permit unless a technical revision or an amendment <br />is filed and approved by the i°lined Land Reclamation Board. <br />Albert Frei & Sons had followed the correct procedure of filing for a <br />technical revision to their approved permit since they have changed their <br />mining plan. (The staff is awaiting a new technical revision since the <br />old one was wiiharawn.) i, <br />i <br />I hope this has cleared up any uncertainties.
