- - -- <br />~-~.~~ ~~ ---~~' ~-~~~ III IIIIIIIIIIIIIIII <br />- 1 0 0 '~- .999 <br />ECEIVED <br />1128 MAIN STREET (719) 275-8881 <br />CANON CITY, COLORADO 81212 APR 2 5 2000 <br />Energy Fuels Coal, Inc. <br />Mr. Alan Weaver, Southfield Mine Division of Minerals 8 Geology <br />1190 County Road 92 <br />Florence, CO 81226 <br />RE: CERTIFICATION OF COAL MINE WASTE BANK, SOUTHFIELD MINE, <br />FLORENCE, COLORADO (4th Quarter, 1999) <br />Dear Al; <br />On December 30, 1999, an inspection was conducted on the permanent coal refuse <br />pile being constructed at your Southfield mine. The inspection was performed by myself, <br />John Effutger III, a registered professional engineer in the State of Colorado since <br />December, 1975. I have experience and knowledge in the design and construction of <br />dams, drainage control, hydrology and structures; including experience in portions of the <br />permitting process of coal mine facilities and permit compliance. <br />The purpose of this inspection and certification was to ensure that proper <br />construction and maintenance techniques were being utilized in accordance with the <br />approved refuse disposal plan and to satisfy the requiretnents of Rule 4.10.2 (1) of the <br />Colorado Mined Land Reclamation Boazd for Coal Mining. In lieu of bi-annual field <br />compaction testing performed by your consultant, Kleinfelder, Inc, or compaction <br />monitored with a "proof-rolling" observation of the active pile, due to inactivity during <br />the holiday season , no positive compaction testing was obtained. In addition to the on site <br />inspection referenced above, actions taken in preparing this certification included review <br />of the re-evaluated stability analysis performed by your consuhant, Terra Matrix, dated <br />December 9, 1996, and review and discussion of several applicable mine maps and state <br />regulations with yourself at your mine site office. <br />Said inspection was performed on a mild (SO°), mostly sunny Thursday afternoon <br />by myself. Most of the site was traversed with a two wheel drive vehicle with frequent <br />stops and hiking trips over, across and around the pile. The following is a statement of my <br />professional observations and conclusions from this inspection: <br />The ent've pile was examined for any failures and none was found. Due to heavy <br />spring rains in April, a large slide occurred on the reclaimed north face of the pile. It <br />appeared that the top-soil overburden became saturated and the angle of repose was <br />exceeded creating a slip face about SO feet wide and 80 feet high (on the lower third of <br />the face), that slid down into the adjacent drainage Swale. At the time of this inspection, <br />the top-soil had been pushed up the face and covering again the pile. <br />
