Mc Berhan Keffelew <br />Apri19, 2007 <br />Page 2 <br />Enhancement and general maintenance of stormwater control features continued in <br />2006. Remaining Amendment No. 8 activities will continue throughout 2007 and <br />beyond. <br />Reclamation in 2006 consisted of transplanting 1,000 one-to-two foot Engleman Spruce <br />trees which were removed from the Wildhorse Mine area prior to mine development. <br />The trees were planted along the Ruby Pad reclamation, the Ironclad Tails reclamation, <br />and the Portland Pit Backfill reclamation. In addition, 1,500 Bristlecone Pine seedlings <br />were planted along the Arequa Overburden Storage Area reclamation. These trees <br />were grown in a commercial nursery from seeds collected at CC&V. Approximately 13 <br />acres along the north slope of the East Cresson backfill received interim reclamation to <br />help stabilize the slope. This area was seeded and fertilized but received no growth <br />medium. <br />Weed control techniques were implemented within the Cresson Project area in 2006 <br />and will continue in 2007. <br />Per the requirements of C.R.S. 34-32-116(3), and C.R.S. 34-32.5-116(3)(a): <br />Reclamation accomplished to date: Approximately 257.5 acres <br />Reclamation accomplished during the preceding year: No final reclamation was <br />completed in 2006, therefore no new map is included with this annual report. <br />New disturbances anticipated during the upcoming year. Continued development <br />of the Main Cresson, East Cresson (including the ECME and Wildhorse areas) and <br />South Cresson, and associated haulroads, sediment control measures, topsoil <br />stockpiles, and other ancillary disturbances required to support these activities. Backfill <br />- of the East Cresson Mine will continue in 2007. <br />Reclamation anticipated during the upcoming year: Approximately 15 to 20 acres <br />of miscellaneous sites consisting of topsoil stockpiles, sediment ponds, exploration <br />disturbances, and portions of the historic Independence Mine tailings are planned to be <br />reclaimed this year. <br />Financial Warranty: <br />Per 2CCR 407-1, 407-4, and Rules 1.15(1)(a), Financial Warranty/Letter of Credit No. <br />1625-04 from the Dresdner Bank AG, New York Branch, in the amount of <br />$33,331,600.00 replaced the St. Paul Fire and Marine Surety Bond No. JZ7711 for the <br />same amount. The new financial warranty was sent to DBMS on July 16, 2004 and the <br />St Paul Fire and Marine bond was released on July 21, 2004. An additional letter of <br />credit (Letter of Credit No. 91 1 1 1 /80085) effective Sept 15, 2004 from Scotiabank in the <br />amount of $3,400,000 was accepted by DBMS on October 19, 2004.
