Building Permit Application for Demolition, Southdown, Inc. <br />Dowe Flats Mining and Reclamation Project <br />Page 2 of 10 <br />A significant wnstraint is property ownership. Southdown has a limited corridor in which <br />to construct the haul road, conveyor, and berms. <br />Regulatory agencies influencing the location and design of the conveyor and haul road <br />corridor include: <br />1. Colorado Department of Transportation (COOT) <br />2. US Army Corps of Engineers <br />3. Mine Safety and Health Administration, US Dept. of Labor <br />4. Poudre Valley REA <br />5. Burlington Northern Railroad <br />6. City of Longmont (Utility Lines) <br />Federal Emergency Management Agency (FEMA) <br />Boulder County (Special Use Permit, Development Agreement, Floodplain Permit, <br />Grading Permit, commitments of record) <br />Colorado Mined land Reclamation Board <br />] 0. Colorado Departrnent of Public Health and Environment <br />The most significant regulatory constraint has been a requirement by COOT that the haul <br />road crossing of Ute Highway be as close as possible to a right (90 degree) angle. The <br />original design of the haul road followed Southdown's western property boundary and <br />crossed Ute Highway at a sharp angle. Because of the new, nearly perpendicular angle, <br />the conveyor crowds the existing structures north of Ute Highway, and the berm footprint <br />includes all of the residence and part of one shed. <br />The barn is not directly in the impact zone; however it is on the verge of structural failure <br />and is a hazard. Once the tenant moves from the single family residence, the barn and <br />sheds would present an "attractive nuisance" site that will create a liability problem. The <br />structures are not associated with a working ranch or farm as Southdown's mining <br />property is leased to an agricultural operator who lives off site. <br />Dowe Flats Barn <br />Another barn in Dowe Flats proper will also need to be demolished. This structure is <br />located near the central valley drainage, approximately 800 feet east of County Road 47, at <br />a point one mile north of the easUwest bend in the road. Design constraints that necessitate <br />the removal of this structure include: <br />• wetlands <br />• relocated County Road 47 <br />• trail dedication and right-of-way <br />• mme quarry <br />
