<br />29 CFR 1910.120 (f). In addition, CONTRACTOR is responsible for providing asite-specific - <br />health and safety plan that meets the requirements of 29 CFR 1910.120 (b). <br />CONTRACTOR shall provide and maintain its own safety equipment in accordance with its <br />Health & Safety Program and all other applicable legal and health and safety requirements. The <br />CONTRACTOR shall also provide its employees and subcontractors with adequate information <br />and training to ensure that all employees and subcontractors and subcontractors' employees <br />comply with all applicable requirements. <br />CONTRACTOR shall coordinate and cooperate with other contractors on safety matters and <br />shall promptly comply with any specific recommendations given by CONTRACTOR or <br />COMPANY. CONTRACTOR shall have the right, but not the duty, to audit CONTRACTOR's <br />compliance with CONTRACTOR'S Health & Safety Program or other applicable requirements <br />at any reasonable time. If deficiencies are noted, CONTRACTOR shall take immediate action <br />to resolve the deficiencies. The failure to note deficiencies shall not be deemed an acceptance <br />of CONTRACTOR'S compliance with applicable requirements. <br />Should CONTRACTOR fail to comply with its Health & Safety Program or with other <br />applicable requirements as referenced above, such action or inaction shall be considered a <br />material breach of the Contract. Should CONTRACTOR upon notice thereof neglect or refuse <br />to take appropriate corrective action, CONTRACTOR or COMPANY shall have the right, but <br />not the duty, to stop the CONTRACTOR'S Work or any portion thereof, and/or correct the <br />condition and backchazge all incident costs to CONTRACTOR'S account. <br />CONTRACTOR shall be responsible for all fines or penalties assessed due to its failure to <br />I comply with applicable laws, regulations or standards, including any fines or penalties assessed <br />against COMPANY or CONTRACTOR. CONTRACTOR agrees, to the fullest extent permitted <br />by law, to indemnify and hold COMPANY and CONTRACTOR harmless from any claim, <br />' liability, loss or expense resulting from CONTRACTOR'S failure to comply with all applicable <br />health and safety requirements. <br />In the event of accident, injury or incident involving health, safety or damage to property, <br />CONTRACTOR shall immediately notify CONTRACTOR and shall submit a report on the <br />incident in writing within 24 hours of such occurrence. CONTRACTOR shall maintain accurate <br />records of all such occurrences and shall, upon CONTRACTOR request, furnish a monthly <br />summary including man-hours lost due to injuries. <br />Nothing in this section shall be interpreted as enlazging the legal duty of CONTRACTOR or <br />COMPANY to CONTRACTOR or to CONTRACTOR'S agents, employees, subcontractors, or <br />third parties or as altering the independent CONTRACTOR status of CONTRACTOR as <br />' provided in Article 13. <br />SC-5.0 COMPANY-FURNISHED ITEMS AND FACILITIES <br />5.1 SUBCONTRACTOR'S WORK Area <br />5.2 Survey Control Points <br />5.3 CONTRACT DOCUMENTS <br />4-3 <br />
