<br />1 CONTRACTOR, by requiring the foregoing minimum insurance coverages, will not be deemed <br />to limit any of the other obligations or liabilities of SUBCONTRACTOR. Deductibles, if any, <br />1 will be the responsibility of SUBCONTRACTOR to pay. <br />If and to the extent required by the SPECIAL CONDITIONS, the COMPANY or <br />' CONTRACTOR will provide "all risk" builder's insurance. <br />GC-39.0 INSPECTION AND RETECTION OF MATERIALS AND WORKMANSHIP <br />' All WORK, including materials, workmanship and places where performance shall take place, <br />shall be subject to inspection and tests by CONTRACTOR at any reasonable time. Failure to <br />inspect, test, discover defects or to object thereto, shall not prejudice or operate as a release or <br />waiver of the rights of CONTRACTOR, including the right to inspect or reject at a later time, <br />nor shall it release SUBCONTRACTOR from complying fully with the CONTRACT <br />requirements. <br />GC-40.0 USE OF FACILITIES PRIOR TO COMPLETION OF THE WORK <br />' CONTRACTOR and COMPANY may take possession and use the WORK or any part thereof <br />' whenever it is in CONTRACTOR'S and COMPANY'S best interests. However, if such use <br />increases the cost or delays completion of the WORK, SUBCONTRACTOR shall be entitled to <br />extra compensation or an extension of time, or both. Use of the WORK, or part thereof, shall <br />in no case be construed as constituting acceptance. Prior to FINAL ACCEPTANCE, all neces- <br />sary repair or adjustment, not due to CONTRACTOR'S or COMPANY'S usage, shall be made <br />by and at the expense of SUBCONTRACTOR. <br />' GC-41.0 TESTING AND START-UP <br />' Unless otherwise provided by this CONTRACT, SUBCONTRACTOR shall perform all required <br />testing and demonstrate that all systems and equipment function in accordance with their intent <br />and the requirements of the CONTRACT. Testing and start-up shall be performed in the <br />' presence of CONTRACTOR'S designated representatives. All results shall be recorded by <br />SUBCONTRACTOR and submitted for the rewrd. <br />' GC~2.0 WARRANTIES <br />SUBCONTRACTOR warrants that its WORK complies with the requirements of the <br />' CONTRACT, is free of defects and is of the highest quality workmanship (12 months after <br />FINAL ACCEPTANCE, or any longer period when covered elsewhere in the CONTRACT <br />DOCUMENTS). Should any defect appear within 12 months, SUBCONTRACTOR shall <br />' promptly and diligently complete repair of the defect as required by CONTRACTOR. Such <br />repair shall be performed at no additional compensation to the SUBCONTRACTOR. <br />' GC-43.0 CLEANUP <br />SUBCONTRACTOR shall keep its WORK azeas in a neat, clean and safe condition at all times. <br />' Upon completion of the WORK, or any separable portion thereof, SUBCONTRACTOR shall <br />3-15 <br />
