4`" Quarter 2006 Refuse Pile Inspection Report, C-1982-056, review, January 3, 2007, page 3 of 3 <br />Rule 4.10.2(2)(b) Inspections shall include such observations and tests as may be necessary to <br />evaluate the potential hazard to human life and property, to ensure that all orgartic material and <br />topsoil have been removed and that proper construction and maintenance aze occurring in <br />accordance with the plan submitted under 2.05.3(8) and approved by the Division. <br />The report is in compliance with this rule. <br />Rule 4.10.2(2)(c) The engineer or other approved inspector shall consider steepness of slopes, <br />seepage, and other visible factors which could indicate potential failure, and the results offailure <br />with respect to the threat to human life and property. <br />The report complies with this rule. <br />Rule 4.10.2(2)(d) See the rules for the text of this rule. This rule is a performance requirement. <br />Rule 4.10.2(3) If any inspection discloses that a potential hazard exists, the Division shall be <br />informed promptly ofthe finding and ofthe emergency procedures formulated for public protection <br />and remedial action. If adequate procedures cannot be formulated or implemented, the Division <br />shall be notified immediately. The Division shall then notify the appropriate emergency agencies <br />that other emergency procedures are required to protect the public from the coal mine waste area. <br />Potential hazards were identified as minimal. Surface drainage appeazed adequate. <br />CDRMS Policy Memorandum, 7/13/84. See Rule 4.09.1(11)(b) above. <br />
