4u' Quarter 2006 Refuse Pile Inspection Report, C-1982-056, review, January 3, 2007, page 2 of 3 <br />Rule 4.09.1(11)(b) The qualifred registered engineer shall provide to the Division a certified <br />report within 2 weeks after each inspection that the fill has been constructed as specif ed in the <br />design approved by the Division. The report shall include a description of any appearances of <br />instability, structural weakness, and other hazardous conditions observed during the inspection. <br />A copy of the report shall be retained at the mine site. <br />The site was visited on August 9 and inspected on December 28. 2006. The report was thus due <br />at the Division on January 1 I. It was received via a-mail at the Division of Reclamation, Mining <br />and Safety (Division) on January 3, 2006, under a Northwest Colorado Consultants, Inc. letter of <br />January 3, 2006. <br />Rule 4.09.1(11)(c) See the rules for the text of this rule. This rule applies to photographs of <br />underdrains. No underdrains were constructed during the report period. <br />Rule 4.10.1(1) All coal mine waste shall be transported and placed in new and existing disposal <br />areas approved by the Division for this purpose. These areas shall be within a permit area. The <br />disposal area shall be designed, constructed, inspected and maintained: <br />This is an inspection report of an existing, under-construction, pile that had been approved by the <br />Division for that purpose. <br />Rule 4.10.1(1)(b) To prevent combustion. <br />Materials were being stockpiled in areas 2 '/: and 3. This is common practice at the site during <br />winter conditions. <br />Rule 4.10.2(1) All coal mine waste banks shall be inspected, on behalf of the person conducting <br />surface coal mining operations by a qualifred registered engineer, or other qualified <br />professional specialist under the direction of the professional engineer, experienced in <br />construction of similar earth and waste structures, approved by the Division. <br />See Rule 4.09.1(11)(a) above. <br />Rule 4.10,2(2)(a) Inspection shall occur at least quarterly, beginning within 7 days after the <br />preparation of the disposal area begins. The Division may require more frequent inspection <br />based upon an evaluation of the potential danger to the health or safety of the public and the <br />potential harm to land, air and water resources. Inspections may terminate when the coal mine <br />waste bank has been graded, covered in accordance with 4.10.4(4), topsoil has been distributed <br />on the bank in accordance with 4.06.4, and revegetated, or at such a later time as the Division <br />may require. <br />This was a report of a quarterly inspection. <br />
