We have a treatment plant there. <br />And the current applicability of your new <br />standard, which was effective the end of January <br />of 1994, in this case, is intended to insure that <br />conditions are not allowed to further deteriorate <br />by current practices. So, our view again, is that <br />the current or future activities at this site do <br />not have a potential to affect groundwater <br />quality, since that time. <br />This Section of the Mined Land Reclamation Act <br />requires that the economic costs of reclamation <br />measures that may be required by the Board bear a <br />reasonable relationship to the environmental <br />benefits derived. And, it's our view and <br />contention that requiring groundwater--a <br />characterization study at the Bulldog does not <br />meet this test. <br />Further, Rule 3.1.7(3)(b)(ii) requires those <br />instances or mining activities that cause or have <br />the reasonable potential to cause degradation of <br />groundwater quality that adversely affects <br />beneficial uses in the area. It's our view that <br />the Division has not provided evidence that <br />beneficial uses in the area have been or may be <br />adversely affected. <br />10 <br />
