On behalf of Kerr, ACZ has <br /> prepared responses addressing each of your comments and questions as follows: <br /> Comment la. We agree with your conclusion that "The reclamation map <br /> would mean more if the topography reflected on-the-ground <br /> conditions. " However, as I am sure you noted during your <br /> review of past annual reclamation reports, no new areas of <br /> final postmining topography have been established since <br /> 1985 even though backfilling of the 720 Pit has been <br /> proceeding on a continuous basis. Additionally, we can <br /> find no specific requirements in the Colorado Regulations <br /> which dictate preparation of certified existing topography <br /> maps for annual reclamation reporting. <br /> Preparation of current certified topographic maps of <br /> reclaimed topography is appropriate when the approved <br /> postmining topography has been established on significant <br /> areas. Accordingly, Kerr will commit to preparing such <br /> maps in the future, most probably in conjunction with <br /> applications for bond release. <br /> If, for some unforseen reason, mapping of the 720 Pit and <br /> overburden stockpile areas becomes necessary, Kerr will <br /> provide this mapping with the annual reclamation report <br /> following map preparation. <br />
