Banks and Gesso, LLC
Conditional Use Permit:
1. Will the conditional use comply with the requirements of the Zoning
Regulations in the area in which it is to be located?
The proposed sand and gravel mine will comply with all applicable zoning
regulations permitting mining operations, as well as any subsequent
conditions applied to the Conditional Use Permit by Adams County.
2. Will the conditional use be consistent with the purposes of the Zoning
Regulations and with the Comprehensive Plan?
According to Special Publication 5-8: Atlas of Sand, Gravel, and Quany
Aggregate Resources of Colorado Front Range Counties, the subject
property lies within the County's Mineral Conservation Overlay Zone
District. The mine and reclamation plan as proposed does maintain
consistency with the Comprehensive Plan and Zoning Ordinances of the
County. The proposed Conditional Use Permit will comply with all zoning
regulations and ultimately results in open space (a lined reservoir). The
proposed open space is complementary to the existing agricultural
character of the area, the South Platte River, and County open space.
No variance or waiver of any development standard is requested.
3. Will the conditional use be compatible with the surrounding area,
harmonious with the character of the neighborhood, not detrimental to the
immediate area, not detrimental to the future development of the area, and
not detrimental to the health, safety, or welfare of the inhabitants of the
area and the County?
The proposed sand gravel mine will not be detrimental to the immediate
area or cause any permanent adverse impacts to the surrounding
community. The proposed use will be of benefd to the community and
County. The proposed project should be viewed in terms of its ultimate
result of a lined water storage reservoir. As an open spacehlvater
reservoir views of the mountains will be preserved. Moreover, the South
Platte River will benefd through the retention of a high quality wildlife area
that is protected from any potential future adjacent intrusive or urbanized
development.
Adams Counly-CUP, Rezonlnp, Flnel Plat Stapecoech Mline.01015
Mob0e Prerpbc concrete, Inc Norembar, 2001
12
