Banks and Gesso, LLC <br />Conditional Use Permit: <br />1. Will the conditional use comply with the requirements of the Zoning <br />Regulations in the area in which it is to be located? <br />The proposed sand and gravel mine will comply with all applicable zoning <br />regulations permitting mining operations, as well as any subsequent <br />conditions applied to the Conditional Use Permit by Adams County. <br />2. Will the conditional use be consistent with the purposes of the Zoning <br />Regulations and with the Comprehensive Plan? <br />According to Special Publication 5-8: Atlas of Sand, Gravel, and Quany <br />Aggregate Resources of Colorado Front Range Counties, the subject <br />property lies within the County's Mineral Conservation Overlay Zone <br />District. The mine and reclamation plan as proposed does maintain <br />consistency with the Comprehensive Plan and Zoning Ordinances of the <br />County. The proposed Conditional Use Permit will comply with all zoning <br />regulations and ultimately results in open space (a lined reservoir). The <br />proposed open space is complementary to the existing agricultural <br />character of the area, the South Platte River, and County open space. <br />No variance or waiver of any development standard is requested. <br />3. Will the conditional use be compatible with the surrounding area, <br />harmonious with the character of the neighborhood, not detrimental to the <br />immediate area, not detrimental to the future development of the area, and <br />not detrimental to the health, safety, or welfare of the inhabitants of the <br />area and the County? <br />The proposed sand gravel mine will not be detrimental to the immediate <br />area or cause any permanent adverse impacts to the surrounding <br />community. The proposed use will be of benefd to the community and <br />County. The proposed project should be viewed in terms of its ultimate <br />result of a lined water storage reservoir. As an open spacehlvater <br />reservoir views of the mountains will be preserved.
