<br />Findings of the <br />Colorado Mined Land Reclamation Division <br />for Transfer of Ownership of <br />Energy Mines No. 1, 2 and Eckman Park <br />Explanation of Findings <br />Pursuant to Rule 2.08.6(4) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the Mined Land Reclamation Division must <br />make three written findings prior to the approval of a transfer of the rights <br />granted under any permit issued pursuant to the Act. <br />These findings are made based on information made available to the Division <br />that Colorado Yampa Coal Company, the applicant, will operate in compliance <br />with the Colorado Surface Coal Mining Reclamation Act and the Regulations <br />promulgated pursuant to the Act. <br />1. The Division finds that the appli~ant will conduct the operations <br />covered by permit number 79-177 in accordance with the requirements of <br />the Act and these Rules (Rule 2.08.6(4)(a)); <br />2. The applicant has submitted a performance bond in the amount of <br />$3,000,000.00 which is equiva]ent to the bond required of the original <br />owner (Rule 2.08.6(4)(b)); <br />3. The applicant will continue to conduct the operations involved in full <br />compliance with the terms and conditions of permit number 79-177 <br />(Rule 2.08.6(4)(c)). <br />/ep <br />Doc.
