The inspection was performed by myself, John
Effinger III, a registered professional engineer in the State of Colorado since December,
1975. I have experience and knowledge in the design and construction of dams, drainage
control, hydrology and structures; including experience in portions of the permitting
process of coal mine facilities and permit compliance.
The purpose of this inspection and certification was to ensure that proper
construction and maintenance techniques were being utilized in accordance with the
approved refuse disposal plan and to satisfy the requirements of Rule 4.10.2 (1) of the
Colorado Mined Land Reclamation Board for Coal Mining. In addition to the on site
inspection referenced above, actions taken in preparing this certification included review
of the results of field compaction testing performed by your consultant, Kleinfelder, Inc,
Dated April 6, 2000, review of the re-evaluated stability analysis performed by your
consultant, Terra Matrix, dated December 9, 1996, and review and discussion of several
applicable mine maps and state regulations with yourself at your mine site office.
Said inspection was performed on a hot (90°), cloudy Friday afternoon by myself.
Most of the site was traversed with a two wheel drive vehicle with frequent stops and
hiking trips over, across and around the pile. The following is a statement of my
professional observations and conclusions from this inspection:
The entire pile was examined for any failures and none was found. The year old
slide damage on the North face appears to have stabilized well.
The entire pile was checked for any springs or seeps and none found, very little
standing water was observed. Lift thickness, material consistencies and placement
procedures appeaz to be in compliance with Terra Matrix re-evaluated stability analysis.
