The Native American Graves Protection <br />and Repatriation Act (NAGPRA) (1990) requires consultation with <br />"appropriate" Tribes prior to intentional excavation or removal <br />of an inadvertent discovery of human remains and associated <br />cultural items. <br />1.2.2 State Regulations <br />Concern for cultural resources has been expressed by the Colorado <br />state legislature in the Colorado Register of Historic Places Act <br />(~S 29-80.1 as amended). This law recognizes the importance of <br />the state's cultural heritage and takes steps to insure that this <br />heritage is considered in the planning process for undertakings. <br />The state law tends to mirror the NEPA provisions for protection <br />of cultural resources at the state, county, and local level. The <br />OAHP (Office of Archaeology and Historic Preservation) is the <br />administering agency for all actions and is therefore responsible <br />for compliance at the state, county and local levels. At <br />present, properties on the Colorado Register of Historic Places <br />are identical to those on the National Register of Historic <br />Places. The State of Colorado passed statutes encouraging <br />counties and local governments to protect cultural resources. <br />House (Colorado) Bills 1039 and 1091 require that cultural <br />resource values be considered when development plans are begun. <br />1.2.3 County Regulations <br />Boulder County has an on-going historic sites inventory program. <br />County planning directives specify that consideration be given to <br />all historic sites within the County during the permitting <br />process. The Boulder County Historic Preservation Advisory Board <br />(HPAB) has the duty to "Serve as a referral body to review and <br />comment on proposed land use regulation amendments and amendments <br />to the Boulder County Comprehensive Plan. as well as development <br />proposals which would affect designated historic landmarks."
