Siegrist, President
Siegrist Companies
b994 York Street
Denver, Colorado 80229
RE: Modification of Siegrist Permit M-82-015 and File M-84-079
Dear Mr. Siegrist:
This letter is to confirm what was conveyed to you verbally on November 5,
1991 regarding proposed modification of your active Permit M-82-015 and File
No. M-84-079.
As the Division understands, a portion of the areas covered by Siegrist
properties covered under Permit M-82-015 and File M-84-079 have been sold to
Weld County who wishes to add these areas to their existing adjacent permit.
In order to do this in a manner best suited to eliminate overlapping permit
areas, Weld County should apply for an amendment to their active permit. This
is done through use of a 112 permit application and all 112 permitting
requirements, including additional bond etc, will have to be met. At the same
time Siegrist should apply to the Division for a technical revision to permit
M-82-015 removing from this permit area all areas to be added to Weld County
permit. Once this technical revision is approved, Siegrist, if it so desires,
can apply for a reduction of bond for Permit M-82-015 to the extent that the
current bond covered activities to be carried on in the area being transferred
to the Weld County permit.
File M-84-079 pertains to a permit application by Siegrist which was approved
by the Division but for which a permit has never been issued. Issuance of
this permit was conditioned on receipt of an acceptable financial warranty.
Inclusion of a portion of this application area in the amendment of Weld
County's permit creates no conflict since permit M-84-079 was never issued.
In order to secure issuance of this permit, since 1t has been over a year
since approval of the application,. a new public advertisement of the
application will have to be made (Rule 1.5.3). In addition, because of the
lapse of time, the Board must reconsider the previous approval (Rule 7.2(2>).
If and when Siegrist decides to pursue issuance of this permit, the Division
would
