All conditions of approval placed at any time by the State <br />of Colorado on any Division of Reclamation, Mining, and Safety permit issued (or any <br />amendment thereto), or any other required State permit (or any amendment thereto), <br />shall likewise be conditions of this Conditional Use Permit. <br />I. Out-of-season dust and blowing materials control. Prior to termination of operations for <br />the mining season (approximately November through April), Applicant shall apply a <br />sprayed tackifer to its exposed stockpiles, or use other means to control b!ox~ing dust <br />and dirt during these months. <br />2. Suspension !Revocation. This Conditional Use Permit shall be automatically suspended <br />or terminate upon. revocation or other termination of any approved Notice of Intent for <br />mining on BLM Lands (or any amendment thereto), or other approval issued by the BLM <br />covering Applicant's operations on the Scott Blue II unpatented mining claim. Likewise, <br />this Conditiona! Use Permit shalt be automatically suspended or terminate upon revocation <br />or other termination of any Division of Reclamation Mining and Safety mined land <br />reclamation permit, or any other permit issued by the State of Colorado. This Conditional <br />Use Permit may also be revoked pursuant to the procedures and requirements of the <br />Teller County Land Usa Regulations in effect at the time. <br />3. Material Representations. Except as otherwise modified by this Permit, all material <br />representations of the Applicant in its submittal package received by Teller County on PAay <br />25, 2007, in correspondence, and in public hearing, shall be binding. Such <br />representations include, but are not limited to: <br />a. Number of employees. <br />b. Use of a night watchman, including without limitation hislher days, hours, and mode of <br />observation. <br />c. Traffic generated. <br />d. Hours, days, and months of operation. <br />e. Use and maintenance at all times of a port-a-potty. <br />f.
