RESOLUTION NO. 08-22-07 (3-3 )
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT for MINING ON THE SCOTT
BLUE II UNPATENTED MINING CLAIM
WHEREAS, The Turquoise Connection, Inc. has made application for a Conditional Use
Permit -Mining on the Scott Blue II unpatented mining claim on federal land, a i.7"v acre portion
of the NE Y., S. 13, T. 15 S, R70W of the 6"' PM, Cripple Creek, Colorado; and
WHEREAS in accordance with the General Mining Law of 1872 and other laws, Applicant
has the right to mine for subsurface minerals on unpatented mining claims legally established on
federal land; and,
WHEREAS, the Untied States Bureau of Land Management (BLM), the State of Colorado,
and Teller County have the equal right to consider and address certain impacts of such mining;
and
WHEREAS, the State of Colorado and the BLM have previously approved and issued its
respective permits and authorizations to Applicant for mining on federal lands as described; and
WHEREAS the Teller County Planning Commission considered Applicant's request on
July 10, 2D07and made recommendation to the Board of County Commissioners that it approve
the request subject to certain conditions of approval; and
WHEREAS the Board of County Commissioners finds that the Application fulfills the
Criteria for Approval of Table 7 of the Teller County Land Use Regulations, and adopts the
findings of County Planning Staff contained in that Staff Report dated August 6, 2007, subject to
the hereafter listed conditions; and
WHEREAS, the Board of County Commissioners hereby finds, determines and declares
that adoption of this Resolution is necessary for the preservation and protection of the public
health, safety and welfare of the inhabitants of Teller County, Colorado;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the
County of Teller, State of Colorado that the Conditional Use Permit -Mining request of The
Turquoise Connection, Inc. is hereby approved, subject to the following Conditions of Approval:
1. General:
a. Annual Reports. Applicant shall submit to the Teller County Planning Department a
copy of each annual report required to be submitted to the Colorado Division
Reclamation, Mining, and Safety (DRMS). Failure tc submit to Teller County one or
more copies of such reports shall be considered grounds for revocation of this
Conditional Use Permit.
b. Equipment. The only equipment approved for use under this Permit is that set forth in
the DRMS 11 C(2) application, page 6 (Exhibit C -Mining Plan), as may be amended
