The operator states, "No slurry wall is planned along Boulder Creek if conventional <br />dry mining is performed because dewatering water will be discharged to the creek. <br />No negative impact to Boulder Creek is anticipated". <br />a. What is the maximum anticipated rate of dewatering that will take place at any <br />given time? <br />b. What impact will this dewatering have on down gradient wells? Please <br />demonstrate quantitatively. <br />c. Since the mining plan anticipates to mine at or below the invert of the channel, <br />the minimum setback from Boulder Creek will have to be .100 feet, unless the <br />operator commits to construct a berm in accordance with the Urllban Drainage <br />Flood Control Manual. <br />4. The Division requests the operator to provide the Division with water quality and <br />depth the approved water replacement plan (plan of substitute supply) or decreed plan <br />for augmentation from the state engineer. Also, prior to the approval of the permit, <br />the Division needs a waiver of objection from all adjacent well owners within 600 feet <br />of the permit or request a hearing before the state engineer. <br />5. The operator has proposed to place 2 ground water monitoring wells along the west <br />side of the existing open lake within a 30 feet setback. The Division requests 3 wells <br />to be placed instead of the two proposed. These wells should be spaced 300-400 feet <br />apart and cover the entire lake area. <br />The operator must provide at least 5 quarters of water quality and depth data before <br />the mining operation begins. It is also advisable to get an agreement with the <br />operator or a waiver in case a damage to his lake occurs. <br />Please provide your response as soon as possible.
