On page 2 of the application the operator states, "No U.S. Army Corps of Engineers <br />Dredge and Fill (404) Permit will be required". However, during the pre-operational <br />inspection of.the proposed mining azea I found two ponds or wet lands that will be <br />mined out. Please provide a written clearance from the Army Corps of Engineers <br />which would allow you to mine these areas or provide a wet lands mitigation plan <br />approved by the Army Corps of Engineer. <br />2. Operator is proposing to place an asphalt batch plant within the permit area. The <br />Division requires the following for the asphalt batch plant area. <br />a. In the area where loading will take place either a concrete pad or a compacted <br />clay liner with permeability area no less than 1x10 cm/sec must be placed. <br />Please provide details of which one you will utilize for the area. <br />b. Place, at a minimum, a 2 foot high berm around the batch plant area to make <br />sure that the spill is contained within the bermed area. <br />2. On pages 11 and 12 the operator states, "a slurry wall construction has been <br />considered both as a potentially necessary mining operation element and as an <br />optional reclamation plan element. Detailed engineering of the optional slurry wall is <br />proposed to be done after a permit is obtained or very soon after mining has begun <br />when performance evaluations can be made." <br />The Division can not approve a plan it has not seen. If the operator plans to <br />construct the slurry wall as part of the operation, please provide the details, otherwise <br />
