Exhibit B Special Stipulations Southway Construction Company Contract MCO-050-MS-88-4 1. At the time of initial surface disturbance, BLM Para- Archaeologist must be at site. Operator will remove snow and the area will then be examined by the BLM Para's. If no evidence of significant cultural values are found, contractor will be allowed to proceed. 2. Purchaser is responsible for reclamation of the entire pit site at the completion of the mining operation in accordance with the approved mining and reclamation plan. 3. Purchaser will notify BLM when a request for release of bond is submitted to the State Mined Land Reclamation Soard. 4. Requirements for bonds, reclamation plans, or special stipu- lations can be modified at any time to meet any situation that may arise or be discovered. 5. Purchaser will submit copies of truck weight tickets showing quantities removed under this contract to the BLM Office in Alamosa on the first (1st) of each month or at the time subsequent installments are paid for. No material will be removed until it is paid for in advance. 6. Installment payments will occur as follows: Payments When Paid For 1 Before Contract is signed (i.e., last increment) 2 Before removal of 1st increment 3 Before removal of 2nd increment 4 Before removal of 3rd increment 5 Before removal of 4th increment 7. Purchaser will notify the Authorized Officer of the following: a. Completion of mining operation b. Commencement of reclamation operation c. Completion of reclamation 8. Any archaeologic or paleontologic finds are to be left intact and reported to the Authorized Officer. Cost of any recovery of such values will be borne by the purchaser. 9. The purchaser will insure that his agents (contractors, sub- contractors, etc.) will receive a copy of the conditions of this contract and insure that those agents accept, understand and comply with all conditions.
