Where semi-annual site inspections ace shown is the plan to be impractical for inactive sites (sites where <br />industrial activity is ao longer conducted), site inspections required by this part shall be conducted at <br />appropriate intervals specified in the plan, but, in no nee less than once is three years. At lease one site <br />inspection required under this part shall be conducted prior to October 1, 1994 or the date two years after such <br />site becomes inactive, whichever is earlier. <br />4. Additional SWMP Reauir®mts <br />a. Signatory Itegtdrmeats: A copy of the plm shall be aigaed in accordanx with Part LD.l0.a, and retained <br />on site. A certification flat the phm bee been colleted and implemented shall be signed and submitted to the <br />Division in accordance with SWMP Deadline. Part I.C.6.a, below. <br />b. SWMP Review/Changes: Upon review of the SWMP, the Division may notify the permittee at any time that <br />the pLa does not meet one or mom of the minimum requirements of this permit. After such notification, the <br />permittee shall make changes to the phm sad shall submit to the Division an update to the plea including the <br />requested changes. Unless otherwise provided by the Division, the permittx shall have 30 days after such <br />notfication to both make the necessary changes to the phm sad to implement them. <br />The permittee shall amend the plan whenever them is a change is design, conatniction, operation, or <br />maintenance which has a significant effect en the potential for the dischuge of pollutants to the waters of the <br />State, or if the SWMP proves to be ineffective in achieving the general objectives of controlling pollutants in <br />stormwater discharges associated with industrial activity. Amendments to the plan may be reviewed by the <br />Division in the same manner ae described above. <br />• It is the permittee's responsibility to notify the Colorado Division of Mining and Geology (formerly the Mined Land <br />Reclamation Division) of soy significant changes at their site resulting from the implemctation of the SWMP. <br />5. SWMP Availability <br />A copy of the SWMP shall be provided to the Division, the Colorado Division of Mining and Geology (CDMG), and/or to <br />EPA upon request, sad within the time fume specified in the request. <br />All SWMPs required tender this permit aro considemd repoAS that shall be available to the public under Section <br />308(b) of the CWA. The owner or operawr of a facility with stormwater discharges covered by this permit aball <br />.make plans available to members of the public upon request. However, the permittee may claim any portion of a <br />storotwater pollution plan as confidential in accordance with 40 CFR PaR 2. <br />6. SWMP Deadlines. Certification <br />a. Certification of SWMP Completion and Lnpl®entatioa: For facilities e~dstiog oa October 1, 1992, as <br />soon as possible but no later than the amiversary date of their Mined Lend Reclamation permit that falls <br />between July 1, 1993 and June 30, 1994, the permittee shall have implemented and be in compliance with <br />their SWMP.. <br />Certification of compliance widt the SWMP shall be submitted to the Division on or before the anniversary <br />date of the Mined Land Reclamation permit that falls between July 1, 1993 and June 30, 1994. <br />For any existing facilities covered under thin permit which do not also have a reclamation permit under <br />. CDMG, the SWMP certification of complUioa and implementation is due to the Division by July 1, 1993. <br />For new facilities (beginning operations after October 1, 1992), sad for all other facilities applying after <br />July 1, 1993, the SWMP shall be prepared prior to applying for coverage under the general permit, and <br />certification of the plan development submitted with the application.
