ponding in the reclaimed areas of the pit. This discrepancy has been corrected in the
enclosed Exhibit E.
22. Temporary stormwater outlet controls at the northeast comer of the permit area are
no longer necessary, given the current plan for water storage ponds in that vicinity,
and the long term plan for wide dispersal and absorption of stormwater for vegetation
use on the finished bench.
23. Re-vegetation seeding on progressively finish-graded and topsoiled slope-banks
shall be delayed only until a large enough unit (% to 1 acre) has accumulated to make
reclamation seeding efficiently accomplished. Any reference to delaying re-
vegetation of progressively finished slope-banks has been removed from the plan.
24. A legume was not recommended by NRCS for the described "topsoil", however it
remains to be seen what shall be recommended for the residual pit floor soils (and
also for topsoils, for that matter), based upon soil tes(S to be cerformed. We shall
discuss this matter with MRCS within the limitations of the lack of available irrigation
and the wishes of the landowner to avoid any specie (such as alfalfa) that may induce
livestock bloating from uncontrolled range grazing ingestion.
25. Preparer's name, signature, and effective date of completion have been added to the
Exhibit F Reclamation Map.
26. The unexplained figures on the Exhibit F Reclamation Map have no pertinent
function and have been removed
27. The Exhibits have been revised to reflect that the production operations water
holding and settling ponds (with 3:1 slope banks) are to be retained following
reclamation.
28. The unintentional exclusion of the remainder of the 5860-foot contour on the
reclamation map has been rectified, hopefully communicating the terminus of
excavation at the permit north boundary and eliminating the confusion the omission
had generated.
Exhibit G -Water Information
29. An agreement has been worked out with the landowner to lease Nucla C-C Ditch
irrigation water rights to be transferred temporarily to industrial use per Colorado
Water Court procedures. Use of the storage/settling ponds constructed and employed
by the operator shall be concurrently employed by the landowner for gravity pressure
